Lawsuit alleges unlawful taking of victim’s vehicle

RICHMOND, Va., July 29, 2021 – Henrico County Commonwealth’s Attorney, Shannon L. Taylor, is being sued over her failure to return a motor vehicle to the victim of an armed robbery.

On the afternoon of June 23, 2021, Rashad Moseley was robbed at gunpoint by three assailants in an apartment complex in the 9300 block of Silver Stream Lane in Henrico County. During the course of the robbery, shots were fired at Moseley while he attempted to flee. The suspected assailants, Jahleem Cooper-Mattison, Jordan Mumford, and Shaquan Carter, were quickly apprehended and are currently being held without bond. They are scheduled for a preliminary hearing on September 1, 2021, in the Henrico County General District Court.

Moseley cooperated fully with the investigation in this case and was told by the investigating detectives that he would have his car returned to him in a matter of days. However, the Commonwealth’s Attorney has decided to hold the vehicle until the conclusion of the case, which could be a year or even longer.

On July 21, 2021, Moseley filed a lawsuit in the United States District Court for the Eastern District of Virginia against the Commonwealth’s Attorney. The lawsuit alleges an unlawful taking of his property by the government. Moseley continues to have to pay his monthly car note and find rides to work; he also has had to secure alternative transportation to take his children to daycare while this matter is pending.

It remains to be seen how Shannon Taylor will defend her office’s stance on this issue. Her office has 21 days to file a written response to the lawsuit with the court.
