How long do you have to file a wrongful death claim?
You have two years to file a wrongful death claim in Alabama. Ala. Code § 6-5-410(d) says that the period is measured from the date of the death of the victim.
Keep in mind that simply speaking with the insurance company doesn’t preserve your rights. You must start your case by filing a summons and complaint in court.
