Wrongful Death – Alabama FAQs

Who can sue for wrongful death in Alabama?

The personal representative or executor of the victim starts the wrongful death lawsuit. The person may be named in the will, or the court may appoint someone. The surviving spouse and other family members are a high priority to serve as representatives.

How long do you have to file a wrongful death claim?

You have two years to file a wrongful death claim in Alabama. Ala. Code § 6-5-410(d) says that the period is measured from the date of the death of the victim.

Keep in mind that simply speaking with the insurance company doesn’t preserve your rights. You must start your case by filing a summons and complaint in court.

What can you receive in a wrongful death claim?

A monetary award can never make up for the loss of life. Losing a family member is a financial, deeply personal, and painful loss.

An important part of any wrongful death claim is fairly valuing your damages. Damages claimed may include loss of financial support and emotional pain and suffering. Our experienced lawyers understand the damages you can claim and how to fully identify what your case is worth. Contact us for a personalized evaluation of what you may receive for your case.

How are wrongful death funds distributed?

Alabama law determines who receives what in a wrongful death claim. It depends on who survives the victim. For example, the spouse would receive the whole amount if there were no children. Similarly, the children would receive the whole amount if there is no spouse, divided equally.

Our lawyers can provide a personalized evaluation of who may recover from your wrongful death claim.

If we receive wrongful death compensation, does it pay off the victim’s debts?

No. Even if the wrongful death victim has personal debt, the compensation that you receive from the claim is yours to keep. A law called the statute of distributions determines how the funds are divided among survivors.

Note: The victim’s estate may be paid toward their outstanding debts, but that process is separate from the wrongful death claim.

Can you bring a wrongful death claim for the death of a minor child?

Yes. Ala Code § 6-5-391 recognizes the rights of parents to commence an action for the wrongful death of a minor child. If they fail to do so within six months, the personal representative may start the case.
