Do I have a bicycle accident claim?

If someone else is at fault for a bicycle collision and you are injured, you may have a claim. It may be a traffic violation, such as not leaving enough space for a bicyclist when passing, or entering an intersection when the bicyclist has the right of way.

Common grounds for a bicycle accident claim include:

  • Entering a crosswalk when a bicyclist is present
  • Failing to leave sufficient following distance for a bicyclist
  • Speeding or not leaving enough time to react
  • Failing to yield
  • Not adjusting speed when bicycles are present
  • Cutting off a bicyclist when they signal a turn
  • Dangerous road conditions or road design
  • Opening a door in front of a bicyclist
  • Drunk driving, distracted driving

Even if the collision involves only the bicycle, poor road conditions or a dangerous road design may be to blame. Contact us for an evaluation of your case.

Bicycle Accident Laws

Alabama bicycle accident laws are found in Alabama Code Title 32 – Motor Vehicles, Chapter 5A – Rules of the Road, Article 12 – Bicycles and Play Vehicles and Article 13 – Bicycle Safety.

Is it legal to ride a bicycle without a helmet in Alabama?

Generally, it is legal for an adult to ride a bicycle without a helmet in Alabama. Helmets are required for children under the age of 16 and people of all ages riding Class 3 electric bicycles. Failing to wear a helmet is not evidence of negligence in a legal action (Ala. Code § 32-5A-283).

Do bicyclists have to use a bicycle path in Alabama?

Alabama Code § 32-5A-263 requires bicyclists to use a designated bicycle path next to a roadway. If there is a bicycle path, it is mandatory to use it.

Is a bicycle considered a vehicle in Alabama?

No. A bicycle isn’t considered a vehicle, but bicyclists are still subject to the rules of the road.

Is an electric bicycle considered a bicycle or a car in Alabama?

Alabama Code § 32-5A-267 says that electric bicycle operators have the same rights and duties as manual-powered bicyclists. You don’t have to register an electric bicycle or have a driver’s license. However, you may not modify the motor-power speed capability of an electric bicycle without changing the required labeling.

How do bicycle accident laws matter in the event of an accident?

If you’re in an accident with a motor vehicle, bicycle accident laws may be an important factor in your case. Motor vehicle traffic laws are important and may be used as evidence of wrongdoing or an explanation of the standard of care.

As bicycle accident lawyers, we understand the laws that apply to bicyclists and can determine what laws may be applicable in your case.
